Under the Health and Safety at Work etc. Act 1974 and the Control of Substances Hazardous to Health (COSHH) Regulations 2002, anyone in control of a premises with a water system landlord, employer, or duty holder has a legal "duty holder" responsibility to identify and control the risk of legionella.

The HSE's Approved Code of Practice, ACOP L8, sets out how that duty should be discharged in practice, backed by the more detailed technical guidance in HSG274.
